1. Acceptance of Terms
By accessing the website, requesting an appointment, or receiving services from M4C, you (“Customer”) agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of our services.
2. Eligibility and Access
You must be at least 18 years old or have parental consent to schedule or receive services.
You are responsible for providing safe, reasonable, and legal access to the appliance and work area.
M4C reserves the right to refuse service in situations that pose safety risks, involve inaccessible appliances, or where a customer behaves in an abusive or inappropriate manner.
3. Scope of Service
M4C provides residential appliance diagnostic, maintenance, and repair services in accordance with California state law and regulations of the Bureau of Household Goods and Services (BHGS). Services are performed only on the appliances and issues described in the written estimate or work order.
4. Estimates and Authorization
M4C will provide a written estimate prior to performing any repair work.
Written estimates are valid for 30 days from the date issued.
Customer authorization (signature and, if required, deposit) is required before service begins.
M4C will not exceed the authorized amount without prior approval, which may be given verbally or in writing.
5. Trip Fee and Diagnostic Fee
- Trip Fee – $75: Applies if a technician is dispatched and arrives but the service is canceled, access is denied, or the customer is unavailable.
- Diagnostic Fee – $120: Applies once diagnostic work begins. The diagnostic fee includes the trip cost and will be credited toward the total repair cost if the customer approves the repair during the same visit.
6. Cancellation and Rescheduling
- Before Dispatch: Appointments canceled before a technician is dispatched will not incur any fees.
- After Dispatch but Before Diagnosis: If an appointment is canceled after the technician has been dispatched, but before diagnostic work begins, a Trip Fee of $75 will apply.
- After Diagnosis Begins: Once diagnostic work has begun, the Diagnostic Fee of $120 will apply. This fee already includes the trip cost and is credited toward the repair if approved during the same visit.
7. Deposits and Special-Order Parts
A deposit may be required when the total job amount exceeds $120, but only for the purpose of ordering special-order parts.
Deposits may only be collected under Home Solicitation Contracts, not under Service & Repair Contracts (see Section 8).
Under California law, if a deposit is collected, the customer retains the right to cancel within 3 business days (Civil Code §1689.6), or 5 business days if 65 or older (Civil Code §1689.7, AB 2471).
During this cancellation period, deposits are refundable, subject to deduction for actual supplier costs such as restocking fees, shipping charges, or non-returnable parts. Documentation of these costs will be provided upon request.
After the cancellation period has expired, deposits become non-refundable once special-order parts are purchased on the customer’s behalf.
8. Service and Repair Contracts (California B&P Code §7159.10)
This agreement may qualify as a Service and Repair Contract under California Business & Professions Code §7159.10 only when all of the following conditions are met:
- The total contract price is $750 or less (B&P §7159.10(a)(1)).
- The customer has initiated contact with M4C and requested prompt service (B&P §7159.10(a)(2)).
- The services provided are limited to what is reasonably necessary to address the specific issue the customer requested (B&P §7159.10(a)(3)).
- No deposit or advance payment is collected before the work is completed (B&P §7159.10(a)(4)).
- The contract is in writing, signed by both parties, titled “Service and Repair Contract,” and states the total price clearly (B&P §7159.10(b)).
If these conditions are satisfied, the customer’s standard three-day right to cancel under the Home Solicitation Sales Act (Civil Code §§1689.5–1689.14) does not apply once work begins.
If any condition is not met (for example, if a deposit is collected or the price exceeds $750), the agreement is treated as a Home Solicitation Contract, and the customer retains the right to cancel within 3 business days (Civil Code §1689.6), or 5 business days if 65 or older (Civil Code §1689.7, AB 2471).
9. Senior Consumer Rights (AB 2471)
Customers aged 65 or older may have up to five (5) business days to cancel certain contracts under California law. M4C will provide any required cancellation notices when applicable.
10. Diagnostic-Only Services
If the customer declines the recommended repair after diagnostic services have been performed, the diagnostic fee still applies. No warranty is provided for diagnostic-only visits.
11. Warranty
- Labor Warranty: 30 days from the date of service.
- Parts Warranty: 90 days on parts installed by M4C, limited to manufacturer terms.
Warranty coverage excludes misuse, accidental damage, or issues unrelated to the original repair.
12. Return of Replaced Parts
Customers may request replaced parts at the time of service authorization. Exceptions include:
- Warranty returns to suppliers or manufacturers.
- Parts that are hazardous or unsafe.
- Rebuilt or exchange-core components.
13. No Guarantee of Same-Day Service
While M4C makes reasonable efforts to provide same-day or next-day service, scheduling limitations, part availability, or unforeseen circumstances may result in delays. M4C is not liable for losses resulting from delays in scheduling or completing repairs.
14. Limitation of Liability
To the fullest extent permitted by law, M4C is not liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits, property damage, or loss of use. Total liability for any claim is limited to the amount paid for the specific service performed.
15. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of the State of California. Any disputes shall be resolved exclusively in the state courts of Santa Clara County, California.
16. Changes to Terms
M4C reserves the right to update or modify these Terms & Conditions at any time. Changes will take effect immediately upon posting on our website. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
